Amulya Leona Granted Bail After 3 Months Of Being Arrested Over A Seditious Activity

After three months of being in jail, Amulya Leona, the college student from Bengaluru who was booked for sedition for saying “Pakistan Zindabad” has been granted bail.

The 5th Additional Chief Metropolitan Magistrate court granted bail to Amulya on the 10th of June under section 167(2) on the CRPC. As per the lawyers of Amulya, the section gives a time period for the police to file a charge sheet after which the accused is entitled to bail. The police have failed to file a charge sheet for 90days. R Prasanna, a lawyer arguing the case said,

“Earlier, the bail that was applied for under Section 439 of the CrPC was rejected by the sessions court. So, on Wednesday, we had approached the 5th ACMM court with a different application seeking default bail under section 167(2). The default bail was granted on Thursday. Formalities are done, we expect her to be released on Friday.”

However, the bail was granted against a personal bond of Rs. 1 lakh with a condition that she cannot influence or obstruct the investigation and also cannot commit a similar offense. On Friday, Amulya is expected to walk out of Parappana Agrahara. Earlier the sessions court had rejected the bail plea for the 19-year-old as it said that she may abscond if she is released.

Amulya Was Arrested In February

Amulya, a student of journalism and English, was arrested in February during a protest against the Citizenship Amendment Act and the National Register of Citizens in Bengaluru. The Member of Parliament and leader from All India Majilis-e-Ittehadul Muslimeen (AIMIM), Asaduddin Owaisi was also present at the event. In the event, when the mic was presented to Amulya, she said “Pakistan Zindabad” thrice and followed it up with “Hindustan Zindabad” but before she could make her point, the mic was snatched from her and was taken away.

Amulya was charged under Section 153A that is promoting enmity between two different group imputations and 153B which says assertions prejudicial to national integration. The Karnataka Government too opposed the bail against Amulya and had said that she may threaten and influencer the witnesses and hamper the investigation.
